Day, a franchisee of Filmlab, then filed a third-party complaint against Dietel, as the alter-ego of Filmlab, Inc., for breach of contract. The court found Dietel to be the alter ego of Filmlab, Inc. and awarded the Judgment holding Dietel personally liable.
